TalkMandarin Terms of Service

These Terms of Service (“Terms”) govern your access to and use of TalkMandarin’s products and services. By using TalkMandarin, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

TalkMandarin provides AI-powered language learning features, which may include:

• Chinese conversation practice
• text and voice-based interaction
• AI-generated replies and learning feedback
• pronunciation and language coaching
• profile and learning settings
• premium or subscription features, if offered

We may update, modify, suspend, or discontinue features at any time.

2. Eligibility and Accounts

You must be legally capable of entering into this agreement, or have permission from a parent or guardian if required by law.

You are responsible for:

• providing accurate account information
• maintaining the confidentiality of your account
• all activity under your account

You may not:

• share, sell, rent, or transfer your account
• use the service through bots or automated methods without permission
• interfere with the normal operation of the service

3. Acceptable Use

You agree not to use TalkMandarin to:

• violate any law or regulation
• infringe intellectual property, privacy, or other rights
• upload or transmit unlawful, abusive, harmful, hateful, violent, or sexually explicit content
• harass, threaten, or impersonate others
• attempt to reverse engineer, scrape, exploit, or disrupt the service
• use the AI service for fraud, spam, or harmful conduct

We may suspend or terminate access if you violate these Terms.

4. AI Content Disclaimer

TalkMandarin uses AI to generate replies, explanations, and learning guidance.

You understand and agree that:

• AI-generated content may be inaccurate, incomplete, or inappropriate in some cases
• the service is provided for language learning and general informational purposes only
• AI output does not constitute legal, medical, financial, educational certification, mental health, or other professional advice
• you are responsible for evaluating and using AI output at your own discretion

5. User Content

You are responsible for the content you submit, including text, audio, and other materials.

You represent that:

• you have the right to submit that content
• your content does not violate law or third-party rights

You grant us a limited right to host, process, transmit, analyze, and display your content as necessary to operate, improve, secure, and support the service.

6. Intellectual Property

The service, including software, design, branding, text, graphics, and related materials, is owned by TalkMandarin or its licensors and protected by applicable intellectual property laws.

Except as expressly allowed, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the service.

7. Paid Features and Subscriptions

If we offer paid plans, subscriptions, or premium features:

• pricing and billing terms will be shown before purchase
• subscriptions may renew automatically unless canceled
• you are responsible for applicable fees and taxes
• payments may be processed by third-party payment providers

Refunds, if any, are subject to applicable law and the terms shown at purchase.

8. Termination

We may suspend or terminate your access if:

• you violate these Terms
• we are required to do so by law
• your use creates risk or harm to us, other users, or the service
• we discontinue the service

You may stop using the service at any time.

9. Disclaimers

To the fullest extent permitted by law, the service is provided “as is” and “as available.”

We do not guarantee that:

• the service will be uninterrupted, secure, or error-free
• AI output will always be accurate, reliable, or suitable for your needs
• any specific result or learning outcome will be achieved

10. Limitation of Liability

To the fullest extent permitted by law, TalkMandarin and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business opportunity arising out of or related to your use of the service.

If liability cannot be excluded, our total liability will be limited to the amount you paid us, if any, in the 12 months before the event giving rise to the claim.

11. Privacy

Your use of the service is also governed by our Privacy Policy.

12. Changes to These Terms

We may revise these Terms from time to time. We will post the updated version with a new “Last Updated” date. Continued use of the service after the updated Terms take effect means you accept them.

13. Governing Law

These Terms will be governed by applicable law. Any disputes arising out of or related to these Terms or the service will be resolved in accordance with applicable law.
